Open Records Act

The Open Records Act ensures that public agencies and their officials are accountable to the people and that the public has the opportunity to know about the affairs of government. All public records shall be open for public examination unless specifically exempted by the Open Records Act.

Public record means all books, papers, maps, photographs, cards, tapes, discs, diskettes, recordings, or other documentary materials regardless of form or characteristics, which are prepared, owned, used, in the possession of, or returned by a public agency. Any instrument included in this definition is subject to inspection by any person.

Importantly, the City is not required to create records. It is only required to produce documents that already exist.


How to Request Records


Open Records Request must be submitted to the city clerk / treasurer of Jeffersontown any of the following ways:

Required Information 

The following minimum information is required when making a records request:

  • Name of requestor (individual or company) – Must be “Resident of Commonwealth”
“Resident of the Commonwealth” means:
(a) An individual residing in the Commonwealth
(b) A domestic business entity with a location in the Commonwealth
(c) A foreign business entity registered with the Secretary of State
(d) An individual that is employed and works at a location or locations within the Commonwealth
(e) An individual or business entity that owns real property within the Commonwealth
(f) An individual or business entity that has been authorized to act on behalf of an individual or business entity defined in                                   paragraphs (a) to (e) of this subsection; or
(g) A news-gathering organization as defined in KRS 189.635(8)(b)1.a.to.e..

 City may request proof that the requestor meets one of the definitions of a “Resident of the Commonwealth”
  • Address
  • Email address (if available)
  • Telephone number
  • Record request information – To expedite the request, be as specific as possible in describing the records being requested; also, please include the type of access requested (copying or inspection), and if data, the medium requested
Fees will be charged depending on how the individual would like to receive the information: $.10 per page per copy, $2.00 per audio tape, and $5.00 per video tape.
